Any child attending a failing school must be offered the option of transferring to a public school or public charter school in the same district. Any child who is a victim of a violent crime at school has the same rights.

These are your rights as a parent:

• School districts must tell you no later than the first day of the school year if your child qualifies for a transfer.
• Schools must give you a list of at least 2 school choices.
• Schools must provide your child with transportation to the new school.

If your child qualifies and your child's school doesn't offer you the choice to transfer out, contact your state Department of Education immediately.
