The Wake County Board of Elections www.wakegov.com/elections has created this list of voters’ rights and responsibilities.
Voters’ Rights
As a voter, you have the right to:
- Vote if you are:
- A U.S. citizen
- 18 years of age or older
- Registered to vote in Wake County at least 25 days prior to the election
- Not currently serving an active felony sentence, or on probation or parole for a felony.
- Receive a notice (voter card) confirming registration, polling places and voting districts.
- Vote in an accessible voting place if elderly or handicapped.
- Have questions concerning voting procedures answered politely and accurately and have an explanation of procedures posted in a prominent place at each voting place.
- Have instructions on the use of voting equipment available at one-stop sites and on Election Day.
- Review a sample ballot before voting.
- Vote if in line at the time the polls close at 7:30 p.m.
- Mark a ballot privately and free from coercion or intimidation.
- Request and receive assistance in voting.
- Have voting instructions posted in English and Spanish.
- Return a spoiled ballot up to three times for a replacement.
- Vote a provisional ballot if not listed on the voter registration list or if there is a question concerning registration information or one’s right to vote.
- Receive written information at the time of voting a provisional ballot regarding how to ascertain whether the provisional ballot was counted, partially counted or not counted and if partially or not counted, a reason for the decision.
- Vote by absentee ballot upon executing appropriate request; no excuse required.
- Have the voted ballot accurately counted, if cast legally and on time.
- Have a uniform statewide standard for counting votes.
- Have election complaints resolved fairly and efficiently.
- Be eligible to vote a challenged ballot if your right to vote has been challenged and sustained.
Voters’ Responsibilities
Each voter has a responsibility to:
- Register to vote at least 25 days before an election. Learn how to register to vote in Wake County.
- Complete a voter registration form completely, accurately and legibly.
- Update address information when necessary.
- Be informed about candidates and issues on the ballot.
- Know location of polling place and hours of operation.
- Follow all federal and state voting laws.
- Read and follow all voting instructions and procedures established by the county Board of Elections and precinct officials.
- Ask questions if unsure of procedures.
- Show proper identification at the polling place, if voting for the first time after registering by mail or at a voter registration drive and if a copy of acceptable identification was not submitted to the county Board of Elections office prior to printing the poll list.
- Sign the Authorization to Vote form.
- Review the ballot before casting it to ensure it is complete and accurate.
- Treat precinct officials and other voters with respect and courtesy.
- Report any violations of election law to the chief judge at the precinct, the county director of elections, the county Board of Elections and/or the State Board of Elections.
- Vote.
Voting Prohibitions:
- You may not make any false statement or claim that you are a citizen of the United States in order to register or vote in any federal, state, or local election.
- You may not vote more than once in any election.
- You may not procure or submit materially false, fraudulent or fictitious voter registration applications in any election.
- You may not submit false information as to name, address or period of residence in voting district for the purpose of establishing eligibility to register or vote in any election.
- You may not procure, cast or tabulate materially false, fraudulent or fictitious ballots in any election.
- You may not pay, offer to pay or accept payment for voting, registering to vote, withholding your vote or voting for or against any candidate in any election.
- You shall not feign a physical disability in order to have persons of your choice assist you.
- Elections officials shall not attempt to influence, persuade, intimidate, bribe or coerce you in any manner that would affect for whom you are voting.
- Elections officials shall not make any false entries on election records.
